Landlord-Tenant Issues:

  • Eviction
  • Marini hearings
  • Security deposit issues
  • Failure to maintain property
  • Failure to pay rent
  • Disorderly tenants

We represent large apartment complexes, yet we do not shy away from helping tenants who are victims of abusive landlords.

Tenants’ Rights
According to the New Jersey anti-eviction statute, a tenant cannot be evicted without cause. As long as a tenant pays rent on time and abide by the terms of the lease, you can stay in your apartment or unit even if your lease has technically expired. Our attorneys vigorously defend the rights of tenants against wrongful eviction, unfair refusal to return security deposits and other issues, such as the failure of a landlord to maintain the property in a habitable condition.

Landlords’ Rights
Tenants have a number of obligations toward their landlords, and we represent landlords in enforcing their rights. Breach of lease such as failure to pay rent, disorderly tenants, noise or failure to obey local laws and ordinances can justify a lawful eviction. We assist with proper eviction notice, damage assessment and collections.

New Jersey landlords must notify a tenant within 30 days if they are not going to return all or a portion of the security deposit with an explanation of why. We routinely represent tenants in civil litigation to obtain double damages against landlords who don't return the security deposit properly.

We file evictions for landlords, yet we vigorously defend evictions for those tenants who are being unjustly evicted.
